The LAST WILL and TESTAMENT of JACOB POWLEY

In the name of God, Amen. I, JACOB POWLEY senior, of the Township of Kingston, County of Frontenac, in the Midland District and Province of Upper Canada, yeoman, being weak and poorly in body, but of sound mind and memory, for which I thank God. Revoking all other, heretofore made, do by these presents make ordain and establish this my LAST WILL and TESTAMENT which is as follows, (that is to say) and first of all I resign my body to the dust from whence it came, to be interred with decent Christian burial, and my soul into the hands of God, who gave it. And as it respects my worldly property I dispose of it thus…

I give and devise to my eldest son, FRANCIS POWLEY, that certain piece or parcel of land known by Lot No. ten in the seventh Concession in the Township of Kingston aforesaid containing two hundred acres of land to the same more or less.

I give and devise to WILLIAM POWLEY, my second son, a deed for Lot No. nine sixth Concession of the aforesaid Township of Kingston.

I give and devise to my daughter, MARY, wife of Ira DARLING, rear half of Lot No. twelve, first Concession of the Township of Loughborough.

I have an order for one hundred acres of land in the Township of Cramme, District of New Castle and Province aforesaid which I devise to my daughter, HANNAH, wife of John DINGMAN. 

I devise to my two daughters, ELIZABETH, wife of Humphra SMITH, and my daughter, REBECCA, wife of Zacharias DAVID, Lot No. one, fourth Concession of the Kingston [Township] to be divided equally between them as they shall agree, provided nevertheless that if my daughter HANNAH fails in obtaining a grant for the Lot given her in Cramme, she must have an equal share of said Lot No. four last mentioned.

I give and devise to my son, JAMES POWLEY, the rear half of Lots No. one and No. two, third Concession in the Township of Kingston aforesaid, with the appurtenances to have and to hold the same with their heirs and assigns forever.

I give and bequeath to my daughter, REBECCA, one cow and three sheep.

I give and bequeath to my son, FRANCIS, one cow.

I give and bequeath to my beloved wife, NANCY POWLEY, one cow, one bed and sufficient bedding to be hers and her heirs forever together with one ton hay yearly while she remains my widow. I also bequeath to her a weaver’s loom and the articles thereto belonging.

I also bequeath to her a comfortable dwelling room with needful furniture unless she chooses to live with my son, JAMES, and have an apartment in the house with him with a competency of provisions and clothing which is to be provided out of the property I leave with JAMES to whom I bequeath all my clothing and remainder of my worldly goods to him and his heirs and assigns forever. NB: The above mentioned provisions bequeathed to my wife is considered to be given in lieu of her Dower. 

I appoint and ordain my son, JAMES POWLEY, and Barnabas Wartman of the Township of Kingston aforesaid to by my true lawful executors to this my LAST WILL and TESTAMENT thereby ratifying and confirming whatsoever they shall justly do by virtue hereof. In testimony whereof I have hereunto set my hand and seal at Kingston the eighth day of June in the year of our Lord one thousand eight hundred and fourteen.

Be it reminded that previous to the execution of the above mentioned WILL and TESTAMENT, after my funeral charges and just and lawful debts are discharged, I give and bequeath to my four sons above mentioned an equal share of the monies in my possession together with that which may be collected as my just dues.
